Canvas GFX, Inc. (“Canvas GFX” or “we” or “our” or “us”) is committed to protecting your privacy and the security of information you provide to us. This privacy policy describes the types of personal information we collect from our Site or that you provide to us through other means, how we may use that information, to whom and under what circumstances we may disclose it, and how we protect it.  By using this Site or voluntarily providing personal information to us, you consent to the terms of this Privacy Policy.  If you do not agree to the policy, please do not use the Site.

1. Information Collection

1.1 Information Directly Collected

We may collect any information, such as your first and last name, email, company name, title, telephone number, address, and credit card information that you provide us when you interact with us. Some examples are when you:

  • When you engage in activities on our websites or within our products,
  • Order or register for products,
  • Download trial versions of software or software updates,
  • Complete a user survey,
  • Request technical support, or
  • Subscribe to newsletters and e-mail publications.

1.2 Information Automatically Collected

Each time you visit the Site, we may automatically collect certain types of information. Some examples of automatic information we may collect are as follows:

  • Your IP address, MAC address, browser type, operating system, device-identifying information, type of computer, and type of Web browser software, the specific webpages visited during your connection, and the domain name from which you accessed the Site.  
  • Information about your browsing behavior, such as the date and time you visit the Site, the areas or pages of the Site that you visit, the amount of time you spend viewing the Site, the number of times you return to the Site and other clickstream data.
  • We may use “cookies” of different types to recognize your computer.  A cookie is a small text file that a website, online application, or e-mail may save to your internet browser and/or your computer’s hard drive for use in subsequent visits to the Site or other sites.

We may use web beacons, match scripts, pixel tags or similar technologies that allow us to know if a particular web page was visited, an e-mail opened, or links in the email utilized.  In some instances, these technologies may allow us to match activities with particular users.

We may combine the information we collect through cookies, web beacons, or other technology tools with other information we have collected from you or information from other sources.

2. How We Use Your Information

Any information collected will be used only by Canvas GFX to improve our products, services and websites, or to communicate with you by phone, e-mail, newsletter, and/or notices. Canvas GFX uses information and/or e-mail addresses for internal purposes only and does not sell, lease or rent information to third parties.

We also may aggregate, de-identify, and anonymize personal information, use such information to analyze the effectiveness of our Services, improve our Services, conduct research, and for other related purposes.

3. Sharing or Disclosure of Your Information

Unless otherwise agreed, we will not disclose to third parties any individually identifying information, such as names, e-mail addresses, telephone numbers, payment information, and other personal information which users voluntarily provide to us, except as follows:

  • We work with business partners who support us, such as data analytics, service providers, and other business partners who partner with our software or business. We also use outside service providers to facilitate the Site and overall operation, and to perform functions on our behalf, such as monitoring visitors to our Site, sending emails and promotional offers, analyzing data, processing credit card payments, and providing customer service. These third-party service providers are prohibited from using personal information for any other purpose and are contractually required to comply with all applicable laws and requirements, which may include Payment Card Industry Data Security Standards if they are processing payments.
  • To the extent necessary to comply with applicable laws or valid legal processes, such as in response to subpoenas or court orders.
  • To protect the rights and intellectual property of Canvas GFX.
  • To investigate, prevent or take action regarding illegal activities, suspected fraud, violations of our policies, or as otherwise required by law.
  • In urgent circumstances to protect Canvas GFX or the personal safety of any individual.

4. Cookies Policy

The Site uses “cookies,” which are small pieces of information stored by your browser or other application on your computer's browser or hard drive. The cookies are used to connect your computer with information stored about your online activity, searches and preferences both within the same website visit and from one visit to the next on the Site and/or other websites. Some examples of this data include your account preferences, user specific information on pages accessed, searched terms or addresses entered, and previous visits to the sites. We use both session ID cookies and persistent cookies. A session cookie expires when your browser is closed, and a persistent cookie may stay on your hard drive for an extended period. Session cookies make it easier for you to navigate our site; persistent cookies can perform such activities as storing your password for forums or blogs so you do not have to sign in every time you visit those areas, and/or may be used to enable us to track and target the interests of our users so as to enhance the overall experience of using our Site.

The “help” portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive new cookies or how to disable cookies altogether. If you reject cookies, you may not be able to participate in certain activities or receive a promotion tailored to you. The Site does not control and does not guarantee the effectiveness of browser-based tools for managing cookies.

We use Google Analytics, Google AdWords Conversion tracker, and other Google services that place cookies on a browser across the website. These cookies help us increase the website’s effectiveness for our visitors. These cookies are set and read by Google. We use AdWords remarketing to market our sites across the web. We place a cookie on a browser, and then a 3rd party (Google) reads these cookies and may serve an ad on a 3rd party site. We may also use web beacons, which are electronic images that may be used on our websites or in our emails. We use web beacons to deliver cookies, count visits, understand usage and campaign effectiveness and to tell if an email has been opened and acted upon.

5. Opt-Out

When you consent to receive newsletters, Canvas GFX may use information it has collected to provide you with mailed or e-mailed notices according to the preferences that you indicate to us. This may include notice in the form of newsletters, website update notices, notification of the availability of new products or product updates as well as information on promotions and special offers. You can elect to not receive any further notices from Canvas GFX, either by 1) unsubscribing directly to any e-mail you receive, or 2) by logging into your account with Canvas GFX where you can unsubscribe or change your preferences. (You can log-in to the preference center once you have submitted your e-mail address to Canvas GFX and it has been processed.)

6. Links to Other Websites

This website may contain links to other sites that are not controlled in any way by us. Please be aware of this when you click on any such links; we are not responsible for the privacy practices and/or policies of any website other than our own. Some third parties may place cookies in advertisements and in other locations on our websites and may place Web beacons in conjunction with such cookies. Information collected by these third parties is subject to those third parties’ policies governing the use and disclosure of personal information. Consequently, we strongly suggest that you review the privacy policy of every website you visit, whether or not they are linked to by our own site.

7. Access to Personal Identifiable Information

If your personally identifiable information changes, or if you no longer wish us to possess your information, you may request correction, updating, or deletion of your information by emailing us at legal@canvasenvision.com. You also may make your request by phone or postal mail at the address/phone number indicated at the end of this privacy policy.

8. Security and Retention of Your Personal Information

Canvas GFX takes the protection of the personal information you provide very seriously. Personal information collected is stored using reasonable industry-standard techniques. However, please be aware that no method of electronic storage can ever be 100% secure.

Canvas GFX may hire certain outside contractors to perform services or functions on our behalf (such as customer support, packaging & shipping). We will only provide those companies the personal information they need to complete the desired service. They are not permitted to use customer information for any other purpose and are obligated to keep your customer information confidential.

9. International Transfers

Information submitted to Canvas GFX may be transferred across national boundaries to or from our servers in Canada and the United States. Canvas GFX will only disclose customer information if required to do so by law or legal process.

10. Children’s Privacy

10.1 Under Age 13

Our Site is not specifically directed toward children, and we do not knowingly collect personal information from persons under the age of 13 on our Site without verifiable parental consent. If we learn that a child under the age of 13 has submitted personally identifiable information online without parental consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law).  If you become aware of any personally identifiable information we have collected from children under 13, please contact us at legal@canvasenvision.com.

11. Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, Canvas GFX and the Site do not recognize DNT.

12. Your California Privacy Rights

California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information.  As discussed elsewhere in this Privacy Policy, we do not currently share the personal information of California residents with third parties for their own direct marketing purposes.  However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.

13. EEA-UK Supplement

This EEA-UK Supplement supplements the information provided elsewhere in this privacy notice and applies to the extent personal information of individuals located in the EEA or UK (or otherwise subject to the EEA-UK Privacy Laws) is processed. “EEA-UK Privacy Laws” mean all applicable laws in relation to the privacy, protection and/or processing of personal data in the EEA and/or UK (or otherwise subject to such laws in such regions) including, without limitation, the General Data Protection Regulation (EU 2016/679) as applicable in the EU (“EU GDPR”) and UK (“UK GDPR”, collectively with the EU GDPR the “GDPR”). Any references to personal information or other terms in this privacy policy shall for the purposes of the EEA-UK Supplement be interpreted in accordance with the same or analogous terms under the EEA-UK Privacy Laws (e.g., personal data).

To the extent the EEA-UK Privacy Laws apply to the processing of your personal information, for the purposes of this privacy policy we act as controllers, meaning in simple terms that we are in control of the personal information we collect in relation to you and make certain decisions as to how we use and protect it. We only process your personal information as a controller when you are a website visitor (i.e. individuals who visit or interact with publicly available sections of this Site), business data subjects (i.e. personnel of our current or prospective business partners and professional advisors that we undertake commercial, corporate, financing, joint ventures, or other business transactions with, excluding personnel of our customers), or prospective customers (i.e. personnel of our potential customers). In all other circumstances, we act as a data processor when processing personal data and this privacy policy does not apply to those processing activities. Instead, in those cases, we will process the personal data in accordance with the terms of the contract we have in place with the relevant controller.

We do not make any decisions regarding you solely using automated decision making (including profiling) based on your personal information where such a decision produces legal effects concerning you or similarly affects you.

We retain personal data for as long as required to fulfill its purposes, noting we may maintain it for longer to address complaints or legal obligations, issues, or proceedings, and in any event, subject to compliance with deletion requests and applicable law. Please contact us if you require details of our retention periods for personal information.

If you do not provide the relevant personal data, we may be unable to fulfill the purposes of processing, which may include being unable to provide you with our services.

13.1 Cookies

In addition to the information noted above, where cookies are not necessary for us to provide the products or services you have requested or the functioning of the website, we will ask you to consent to their use. Depending on your preferences and consent, the website will deploy the cookies listed below:

13.2 Transfers

As indicated above, we may transfer your personal information outside of the EEA and UK. When we do so, we do so in compliance with applicable laws, including: (i) only sending information to countries that have good privacy protection laws which are approved to receive such information (i.e. further to an adequacy decision or equivalent); (ii) ensuring appropriate safeguards are in place such as by entering into agreements which contain appropriate contractual protections (e.g., the European Commission approved standard contractual clauses or equivalent (“SCCs”) or their equivalent) with the parties we send your information to; and (iii) sending information as otherwise permitted (e.g., derogations), noting, if safeguards are relied on in relation for such transfers of your information, you may request a copy of the appropriate safeguards (e.g., SCCs).

12.3 Rights under EEA-UK Privacy Laws

To the extent we process your personal information that is subject to EEA-UK Privacy Laws, you have a right to:

  • request confirmation as to whether we process your personal information and to access and receive a copy of the personal information we retain about you;
  • request we correct any inaccurate information contained within your personal information that we retain
  • request we delete any of your personal information that we retain;
  • request we restrict the processing of your personal information that we retain, including the purposes for which personal information is processed;
  • object to the processing of your personal information that we undertake;
  • direct the transfer of your personal information to a third party designated by you;
  • withdraw your consent to our processing of your personal data at any time; and
  • not be subject to solely automated decision-making.

Furthermore, you have a right to lodge a complaint with the appropriate supervisory authority. These rights are not absolute and in certain circumstances their exercise may not be possible including when personal information must be maintained to comply with applicable laws. We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

14. Changes to Privacy Policy

We may change this privacy policy from time to time, including as required to keep current with rules and regulations, new technologies and security standards. When we do, we will post the change(s) on our website. If we change the policy in a material and retroactive manner, we will provide appropriate notice to you.
